Business Structure & Registration

Business Structure: Keep It Simple First
If you’re doing business under your own name and haven’t filed any paperwork, you’re already a sole proprietorship. It’s the default. No forms, no fees, no waiting.
The catch? Your personal assets (your house, your savings, your car) are fully exposed if something goes wrong. Someone gets hurt during a flight, or you damage property, and you’re personally liable.
When to Form an LLC
An LLC creates a legal wall between your business and personal assets. If your drone business gets sued, your personal stuff stays protected.
Cost: $100-$500 depending on your state. Filing is straightforward through your Secretary of State’s website.
Most solo drone operators start as sole proprietors and form an LLC once revenue is consistent. Around $2,000+ per month is a good benchmark. Don’t overcomplicate day one, but don’t wait forever either.
DroneZone Registration
Any drone over 250 grams (0.55 lbs) used for commercial purposes must be registered through the FAA’s DroneZone portal. That’s basically every drone you’d use professionally.
- Cost: $5 per drone
- Valid: 3 years
- Requirement: Mark your drone externally with the registration number
Flying an unregistered drone commercially is an FAA violation. Fines start at $27,500 for civil penalties. Register it.
Remote ID Compliance
Remote ID functions as a digital license plate for your drone. It broadcasts your identity, location, and the drone’s location.
- Drones manufactured after September 2022 must have Remote ID built in
- Older drones need a Remote ID broadcast module attached (around $150-$200)
- Required for all commercial flights
Local Requirements
| Requirement | What It Is | Typical Cost |
|---|---|---|
| Business license | City/county registration to operate | $50-$100/year |
| DBA filing | Required if using a business name (not your real name) | $10-$50 |
| Sales tax permit | If your state charges sales tax on services | Varies |
Check your local government website for specifics.
EIN and Business Banking
Get Your EIN (Free)
An Employer Identification Number is free from the IRS at IRS.gov and takes about 5 minutes. You need one if you form an LLC or plan to hire anyone.
Some companies charge $50-$200 to “help” you get an EIN. It’s free directly from the IRS. Don’t pay for it.

Separate Your Finances
Open a business bank account from day one. Mixing personal and business transactions creates a tax nightmare and weakens your liability protection. Most banks offer free business checking for small accounts.
Quick Check
Q: Do I need an LLC before flying commercially? A: No. You can operate as a sole proprietor. Business structure is separate from FAA requirements.
Q: What if my drone doesn’t have Remote ID? A: You must add a Remote ID broadcast module (roughly $150-$200) or upgrade to a compliant drone. No exceptions.
Q: Should I use my personal bank account for drone income? A: Technically legal as a sole proprietor, but strongly discouraged. Separate accounts make taxes easier and look more professional.
